Happy New Year!

I was doing some leisurely blog reading, and I came across this article. It is not about law at all. However, since so much of the training and discussion of persuasion that goes on in the legal world is reprogrammed from advertising, it’s worth considering the blogger’s point: if product placement is starting to be something people notice, what other things do average consumers “evolve” into noticing?

Further, will juries and judges ultimately learn enough about the psychological techniques that are being developed so that we might one day say, “Objection—Intentional Appeal to Reptilian Brain?” I think it might.

What we consider to be elements of justice and due process has evolved. Certainly, someone wielding the persuader’s equivalent of a magic wand distorts, if not perverts, that process.

Again, this is not to say that these techniques don’t work. It’s just a question of how long. If you really want to be on the cutting edge, you need to get back in the box and see what’s next.
