currently, California’s FEHA, at Gov Code 12940(o), makes unlawful:
“(o) For an employer or other entity covered by this part, to
subject, directly or indirectly, any employee, applicant, or other
person to a test for the presence of a genetic characteristic.”
I don’t know if the federal legislation is similar in focusing on the prohibition on testing….
The federal legislation prevents more than testing; it creates a new protected class.
